The Chairman of the CRE referred a request for a penalty against EDF and EDF Trading Limited to the CRE’s Dispute Settlement and Sanctions Committee (“CoRDiS”), which issued two decisions on April 25, 2022 (No. 02-40-18), for the first time in the electricity sector, the provisions of Articles 3, 4 and 5 of the European Regulation (EU) n°1227/2011 of the European Parliament and of the Council of 25 October 2011 concerning the integrity and transparency of the wholesale energy market (“REMIT Regulation”).

These decisions provide seminal legal interpretations of the REMIT Regulation.
